References to the “Service” in this policy refer to the optimization software, including the application, provided by Energy Bank under a separate customer agreement. The customer’s agreement with Energy Bank is referred to below as the “Agreement”.

This processing is also necessary to fulfill Energy Bank’s obligations under the Agreement.

Your personal data may also be disclosed to third parties when required by law, regulatory decision, or court order, or to defend Energy Bank against legal claims.

3. Processing as data processor

Energy Bank may process personal data on behalf of its customers as a data processor. In such cases, we follow the instructions given by the customer as set out in a data processing agreement between Energy Bank and the customer.

If you have questions or wish to exercise your rights regarding personal data processed by Energy Bank in its capacity as a data processor, you should contact the legal entity that has entered into the Agreement with Energy Bank (i.e., the entity that provided you access to the Service).

4. Changes to the privacy policy

Energy Bank may update this privacy policy. If changes are made, we will inform you on our website. Continued use of the Service after changes take effect implies acceptance of the updated policy.
